Effective May 14, 2015 ISF will be in Full Enforcement status for ISF-10.

The ISF (Importer Security Filing) Enforcement will be issued by the local US Customs ports; Liquidated Damages will no longer be funneled through Headquarters.  Warnings will no longer be mandated, they may still be issued, however that is no longer a requirement in order for CBP (US Customs and Border Protection) to issue Liquidated Damages.

The Enforcement will be based on Timeliness of ISF (24 hours prior to loading on the vessel destined for the United States) and the Bill of Lading Match; each subject to $5,000 Liquidated Damages.

The Liquidated Damages can be mitigated to $1,000 for first time offenses, and $2,500 thereafter.  An additional ½ reduction can be obtained for C-TPAT participants.

An Importer’s C-TPAT (Customs-Trade Partnership Against Terrorism) status or participation may be threatened with any ISF non-compliance.
